The Covenant of the Right to Convey


THE COVENANT OF THE RIGHT TO CONVEY. The covenant of seizin in those states that follow the rule that it is a covenant of title and not merely of possession, is equivalent to or synonymous with the covenant of right to convey. But where seizin means possession merely, and the party covenants that he has a right to convey, it is interpreted that in addition to being in possession he has the title.

The covenant of right to convey is broken, if at all, as soon as made, and is governed by the same rules in regard to pleadings and damages as the cov enant of seizin.
